Welcome to CrossCam!

These Terms of Service ("Terms") govern your use of the CrossCam platform at https://crosscam.top ("Platform") and the services provided by CrossCam. By using our Platform and services, you agree to be bound by these Terms.

1. Description of CrossCam

CrossCam is a professional remote interview platform that provides dual-camera monitoring, real-time AI proctoring, automatic transcription, and AI-powered interview summaries. The Platform enables browser-based video interviews with comprehensive monitoring and documentation features.

2. Service Plans and Subscriptions

2.1 Free Trial

We offer a Free Trial plan that includes up to 3 interviews with basic features including dual-camera setup, AI proctoring, recording, and transcription. No credit card is required for the Free Trial.

2.2 Professional Plan

Our Professional plan provides unlimited interviews with advanced features including AI interview summaries, screen sharing, and priority support. The Professional plan is billed as a subscription through Stripe.

2.3 Billing and Payments

Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your chosen plan). Payment information is processed securely through Stripe, our third-party payment processor. You authorize us to charge your payment method for the subscription fees.

2.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting support. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial subscription periods, except as required by law or at our sole discretion.

3. Acceptable Use

You agree to use CrossCam only for lawful purposes and in accordance with these Terms. You agree NOT to:

- Use the Platform to conduct interviews without proper consent from all participants
- Record or transcribe participants without their knowledge and consent
- Share, distribute, or sell interview recordings without authorization from all participants
- Use the Platform to discriminate against candidates based on protected characteristics
- Attempt to circumvent or disable AI proctoring or security features
- Violate any applicable laws, regulations, or third-party rights
- Upload malicious code, viruses, or harmful content
- Interfere with the Platform's operation or other users' access

4. Interview Content and Ownership

4.1 Your Content

You retain ownership of interview recordings, transcripts, and related content generated through your use of the Platform ("Your Content"). You grant CrossCam a limited license to store, process, and transmit Your Content solely to provide the Platform services.

4.2 Participant Consent

You are responsible for obtaining proper consent from all interview participants before recording, transcribing, or monitoring interviews. You must comply with all applicable laws regarding recording, data protection, and privacy.

4.3 Data Retention

Interview recordings, transcripts, AI summaries, and proctoring logs are stored securely for the duration of your subscription. You may delete content at any time through your account. We reserve the right to delete data after account termination or subscription expiration, as outlined in our Privacy Policy.

5. AI Proctoring and Monitoring

The AI proctoring feature detects and logs events such as no face detected, multiple faces in frame, and participants looking away from the screen. AI proctoring provides information to help you assess interview integrity but does not make determinations about candidate suitability. You are solely responsible for all hiring and assessment decisions.

6. Intellectual Property

The CrossCam Platform, including its software, design, features, and branding, is owned by CrossCam and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Platform.

7. User Data and Privacy

We collect and process personal data, interview recordings, transcripts, and AI analysis as described in our Privacy Policy at https://crosscam.top/privacy-policy. By using CrossCam, you consent to data collection and processing as outlined in the Privacy Policy.

8. Service Availability and Modifications

We strive to maintain high Platform availability but do not guarantee uninterrupted or error-free service. We reserve the right to modify, suspend, or discontinue any aspect of the Platform with or without notice. We may perform scheduled maintenance that temporarily affects service availability.

9. Limitation of Liability

To the maximum extent permitted by law:

CrossCam is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be error-free, secure, or uninterrupted.

We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform, including lost profits, data loss, or business interruption.

Our total liability for any claims related to the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.

Some jurisdictions do not allow certain liability limitations, so the above may not apply to you.

10. Indemnification

You agree to indemnify and hold CrossCam harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

- Your use of the Platform
- Your violation of these Terms
- Your violation of any law or third-party rights
- Interview content you create or conduct through the Platform
- Failure to obtain proper consent from interview participants

11. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any reason at our sole discretion. Upon termination, your right to access the Platform ceases immediately.

12. GDPR and International Use

For users in the European Union, we comply with GDPR requirements as outlined in our Privacy Policy. If you access the Platform from outside the United States, you are responsible for compliance with local laws.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law.

14. Changes to These Terms

We may update these Terms periodically to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes via email or Platform notification. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

16. Entire Agreement
